First-degree assault is a serious criminal offense that is committed when a person causes or attempts to cause a serious physical injury to another person without legal justification. Conduct that would normally be considered a second-degree assault that is coupled with the use of a firearm is also considered to be an assault in the first degree.

First-degree assault is a felony offense. If convicted, a person faces a maximum penalty of up to 25 years incarceration.
What is Second-Degree Assault?
Second-degree assault is a serious criminal offense that is committed when a person causes or attempts to cause a harmful or offensive contact to another person that is not consented to nor legally justified.
What is the Penalty for Second-Degree Assault?
Civilian Victim. If the victim is a civilian, then second-degree assault is a misdemeanor offense. If convicted, a person faces a maximum penalty of a fine up to $2,500 and/or up to 10 years incarceration.
First Responder Victim. If the victim is a first responder, then second-degree assault is a felony offense. If convicted, a person faces a maximum penalty of a fine up to $5,000 and/or up to 10 years incarceration.
