Sodomy is the sexual penetration of a man’s or a woman’s or an animal’s anus by another man.

To be convicted of sodomy, the State must prove the following beyond a reasonable doubt:

      1. That the Defendant either:
        1. Placed his penis into the anus of another person or an animal; or,
        2. Permitted another person or an animal to place his penis into the anus of the Defendant.

Sodomy is a felony punishable by up to ten years of incarceration.


Incest is the vaginal intercourse between a man and a woman who are prohibited by law from marrying.

To be convicted of incest, the State must prove the following beyond a reasonable doubt:

      1. That the Defendant knowingly engaged in vaginal intercourse with another person;
      2. That the Defendant is related to the other person in such a manner that they are prohibited from marrying under Maryland law; and,
      3. That the Defendant knew that the other person was related to him or her at the time of vaginal intercourse.

Incest is a felony punishable by a minimum of one year of incarceration and a maximum of ten years of incarceration.
