What is Maintaining a Common Nuisance?

In the State of Maryland, maintaining a common nuisance is a criminal offense defined as knowingly maintaining any place that is used for the manufacture, distribution, or use of controlled dangerous substances (CDS) or drug paraphernalia.  A “common nuisance” refers to any place that is used or intended to be used for unlawful activities, such as drug-related activities.

To prove the offense of maintaining a common nuisance, the State must show that the Defendant knowingly maintained a place where CDS or drug paraphernalia was used, manufactured, or distributed.  The State does not need to prove that the Defendant actually used or sold drugs, only that the place was used for these activities.
