What is Malicious Burning Under Maryland Law?

Malicious burning is a criminal offense in Maryland involving the willful and malicious setting fire to or burning of someone else’s property. The state recognizes two degrees of this crime:

  • First-Degree Malicious Burning (Maryland Code Criminal Law 6-104):
    • Setting fire to or burning personal property of another with a value of $1,000 or more. Penalties include up to 5 years in prison and/or $5,000 in fines.
  • Second-Degree Malicious Burning (Maryland Code Criminal Law 6-105):

    • Setting fire to or burning personal property of another with a value of less than $1,000. Penalties include up to 18 months in jail and/or $500 in fines.

To convict you of malicious burning, prosecutors must prove beyond a reasonable doubt that you acted both willfully (intentionally) and maliciously (with intent to harm). Our skilled defense attorney will thoroughly examine all evidence, police procedure, and witness testimony to identify weaknesses in the state’s case against you.
