What is a Warrant?

In this context, a warrant is an order signed and issued by a judicial officer that allows the police to arrest and detain a particular individual.  Again, in this context, there are two types of warrants:  arrest warrants and bench warrants.  

What is an Arrest Warrant?

An arrest warrant authorizes law enforcement to arrest and take an individual into custody based on one or more allegations that the individual was involved in some sort of criminal activity.

What is a Bench Warrant?

A bench warrant is like an arrest warrant in a functional sense in that it authorizes the police to arrest and take an individual into custody.  A bench warrant differs from an arrest warrant because it can only be issued by a judge and the reasons for issuing it a different.  Typical reasons that a bench warrant may be issued include, but are not limited to, the following:

  • Being late to court
  • Missing court
  • Violation of probation
  • Contempt of court
